In the subpoena, the Committee states that the combination of "publicly available information and information produced to the Select Committee" indicates that Navarro has "documents and information that are relevant to the Select Committee's investigation."
The Committee does not detail any of the non-public information they have gathered but does use publicly-available information, much of it directly produced by Navarro.
It cites a Rolling Stone article by Tim Dickinson, that details Navarro's and former Trump advisor Steve Bannon's plan to delay the certification of the 2020 presidential election and overturn the results. The plan was titled the "Green Bay Sweep" after a football play from the 1960s designed by iconic Green Bay Packers coach Vince Lombardi in which a running back would push their way into the endzone behind a phalanx of blockers.
In an interview with the Daily Beast, Navarro claimed that “It was a perfect plan,” and that “We had over 100 congressmen committed to it.” The January 6 "Green Bay Sweep" was, "designed to get [Republicans] 24 hours of televised hearings,” and "bypass the corporate media," according to Navarro.
The Committee cites Navarro's plethora of public comments on January 6 as a primary reason for their interest in his testimony.
"Because you have already discussed these and other relevant issues in your recently published book, in interviews with reporters, and, among other places, on a podcast, we look forward to discussing them with you, too," the subpoena reads.
The Committee set a date of February 23, 2022, for Navarro to produce the requested documents, with a March 2, 2022, date set for a deposition.
Navarro released a statement indicating that he will not comply with Select Committee's subpoena.
"As the domestic terrorists running the January 6 partisan witch hunt are well aware, President Trump has invoked Executive Privilege; and it is not my privilege to waive. They should negotiate any waiver of the privilege with the president and his attorneys directly, not through me," Navarro's statement reads.
Navarro directs the Select Committee to reference, "Chapter 21 of In Trump Time for what is in the public record about the Green Bay Sweep plan to insure election integrity."
In December 2021, Navarro was subpoenaed by Congress over the Trump administration's handling of the coronavirus pandemic. Navarro, originally brought in as a trade advisor, was closely consulted on the administration's virus strategy.
Navarro reportedly refused to testify due to a "direct order" from Donald Trump, and was told to claim executive privilege to prevent his testimony.
Navarro wrote to the committee on December 7, 2021, stating “This matter is out of my hands and something that the Sub-Committee should discuss with President Trump’s counsel.”
The vast majority of individuals subpoenaed by the Committee have cooperated with the investigation without incident. A few individuals have refused to testify. Thus far, only Bannon and former Trump-era White House chief of staff Mark Meadows have been held in Contempt of Congress over their failure to cooperate.
