A bailiff arrested corporate property, April 16, the day after the city Arbitration Court made its verdict to satisfy a Tax Ministry back tax claim for 2000 at 99.342 billion rubles, slightly above $3.4 billion. A first-instance court confirmed the claim, May 26, and the board of appeal, June 29.
Backed by the top city prosecutor, the Moscow bailiff service launched criminal proceedings on an attempt to thwart verdict execution, the Justice Ministry says in an official statement.
The federal bailiff board launched proceedings on a city arbitration court writ of May 26 to reimburse more than 99 billion rubles into the federal purse. The debtor company was granted five days to pay, after which the bailiffs appeared. Despite all Yukos promises to cooperate, the bailiffs met resistance to their legal claims from functionaries of corporate registered stockholders. They shirked their duty to offer the bailiffs information about Yukos assets to hamper verdict execution. The board accordingly launched proceedings on the Criminal Code, Clause 315, for preventing court verdict execution to collect the Yukos budgetary debt. Investigation is underway. The bailiffs are determined to act on just as tough, proceeding from the acting legislation, says the statement.
