CONVICTED COLONEL APPLIES FOR PARDON. APPEAL CONSIDERED WRONGLY, ASSUMES MINISTERIAL OFFICER

MOSCOW, September 20 (RIA Novosti) - Yuri Budanov's appeal for pardon was probably considered with procedural violations, suspects a Justice Ministry functionary Novosti has interviewed.

As the procedure requires, supplementing an application must be information about reimbursing damages done by the crime. Now, according to a certificate the convict added to his application, he has paid 11,000 rubles to the family of Elsa Kungayeva, his victim, while the court verdict estimated the damages at 380,000 rubles, roughly $13,500. Budanov missed many other things, too, while applying, added our informant.

Vladimir Shamanov, Ulyanovsk regional governor, signed an appeal for Budanov's pardon. It has been forwarded to the Kremlin staff, with an appropriate file, Anatoly Zherebtsov, chief of the regional commission for convict pardoning, said to Novosti.

Shamanov commanded the 58th Army, stationed in the North Caucasus, while Budanov was serving in Chechnya. Now, the murderer is in convict camp No. 3 in Dimitrovgrad, Ulyanovsk Region.

The regional pardon commission went to the camp for session, September 15, and determined to satisfy his application.

Colonel Yuri Budanov, once in command of the 160th Tank Regiment, killed Elsa Kungayeva, Chechen girl of eighteen, in summer 2000. The North Caucasian district court martial made a verdict of "guilty", July 25, 2003. Budanov was convicted to ten years in a maximum-security prison, demoted in rank, and deprived of his Order for Valor.
