Strasbourg court gets complaint against Russia, Georgia over five-day war

A Georgian human rights organization sued Russia and Georgia in the European Court for Human Rights over the five-day war the two states fought in August 2008.

A Georgian human rights organization sued Russia and Georgia in the European Court for Human Rights over the five-day war the two states fought in August 2008.

A source in the Human Rights Priority organization told RIA Novosti that a package of complaints was made on behalf of families of several civilians killed in the conflict. It includes both individual and group claims.

"According to the Georgian legislation and international conventions, the Georgian side should have warned the civilian population and evacuate [them]... Russia was also obliged to protect the population in order to avoid casualties on the territory under its control," the source said.

The Human Rights Priority said there has been no investigation into the matter, though a criminal case had been launched.

The organization is set to submit more complaints to the court next week.

Russia has lost the majority of cases brought against it in the Strasbourg-based court.

Russia and Georgia fought a brief war in August 2008 when Georgia attacked its former republic of South Ossetia in an attempt to bring it back under central control.
