“The Federal Government seeks an immediate stay pending appeal of a nationwide preliminary injunction against the Department of Homeland Security,” the DOJ asked the US Fifth Court of Appeals.

Led by the State of Texas, the plaintiffs in the case are trying to overturn Obama’s executive order on immigration that would allow millions of undocumented immigrants to stay in the country.

Last month, Texas Judge Andrew Hanen issued a temporary injunction to prohibit the executive order from being implemented. The DOJ is asking the appeals court to lift the ban pending the appeals process.
