WASHINGTON (Sputnik) – The US state of Alabama is ignoring a death row inmate’s claim of innocence as his health deteriorates, according to media reports.
Legal arguments filed by 67-year-old Donnis Musgrove’s lawyer claim the state of Alabama is arguing over technicalities and not addressing legitimate concerns about his 1988 conviction and death sentence, the Guardian reported on Monday.
"We would love to get him out of prison… so he could have some peace after being wrongfully imprisoned for so many years,” Musgrove’s lawyer Cissy Jackson was quoted as saying.
Musgrove’s defense is requesting a federal appeals court make a quick decision because the inmate has lung cancer and is hospitalized.
Musgrove was sentenced to death in 1988 for killing Coy Eugene Barron. However, his attorneys argue the prosecution falsified all evidence used against him. The state claims Musgrove’s lawyers cannot bring up new information questioning the validity of evidence used against him.
