Judge Vance D. Day, who has served the third judicial district of Oregon since 2011, has refused to perform marriages all together and he is advising clerks to refer gay couples to other judges.
According to KATU, Day’s spokesperson said the judge is now under investigation by the
Oregon Commission on Judicial Fitness and Disability following 13-point complaint which will be addressed in court this fall.
The Marion County judge’s decision comes after a clerk in Rowan County, Kentucky, was jailed this week for refusing to issue marriage licenses to same-sex couples. On Friday, deputies for clerk Kim Davis complied with the courts and issued marriage licenses to James Yates and William Smith.
