TOKYO (Sputnik) — The Japanese Supreme Court declared on Wednesday unconstitutional a 19th century law, according to which a woman has no right to remarry within six months after a divorce.
The law was introduced in 1898 due to the need to avoid possible disputes over paternity, in case a child is born within six months after the divorce.
In November, a Japanese woman filed a lawsuit against the state, claiming that the remarriage ban limits the rights of women.
Proponents of the law repeal claimed that the issue of paternity can currently be easily determined by DNA test.
