Australia Gets Legal Go Ahead to Keep Sending Asylum Seekers to Offshore Centers

The High Court of Australia has reaffirmed Canberra's right to send asylum seekers to Australian-run processing facilities in Papua New Guinea (PNG) in accordance with the 2013 resettlement arrangement between Australia and PNG.

MOSCOW (Sputnik) The case was filed by an Iranian asylum seeker who has been held in a refugee camp on Manus, the main processing center in PNG, since 2013. His refugee status was canceled in December 2016. He claimed that the PNG's order of April 2016 invalidated the deal between Australia and PNG.

"The High Court held that neither the legislative nor the executive power of the Commonwealth is constitutionally limited by any need to conform to the domestic law of another country and that the past and future actions challenged by the plaintiff were not invalid or precluded… The Court answered the questions stated in the special case adversely to the plaintiff," the ruling by the court said.

Under the regional resettlement arrangement between Australia and Papua New Guinea of July 2013, also known as the PNG solution, asylum seekers coming to Australia by boat without a visa are to be settled in Papua New Guinea, in the first instance, Manus Island, and other participating regional states, including Pacific Island, and considered ineligible for resettlement in Australia.

In April 2016, Papua New Guinea's (PNG) Supreme Court ruled as illegal the detention of migrants applying for asylum in Australia at the center located on PNG's island of Manus, saying that the detention in the camp violated the right to personal liberty in the country's constitution. In July 2017, media reported that the Manus detention center was gradually closing down.
