An investigation proving guilt in the 2014 downing of Malaysian Airline flight MH17 in Ukraine last July must first be completed before prosecuting those responsible for the crash, US Senator Bob Menendez told Sputnik on Wednesday.

WASHINGTON (Sputnik) — US Senator Bob Menendez told Sputnik:

“First, you have to determine who are the guilty parties,” Menendez said. “[F]or me, the guilt starts with who provided the weapons system that ultimately was used by individuals that brought the plane down.”

The UN Security Council is considering a draft proposal on Wednesday to create an international tribunal to investigate and prosecute those responsible for the MH17 incident that killed all 298 passengers onboard.

Moscow has stated its intention to vote against the UN resolution, arguing the creation of a tribunal is premature before a full investigation.

Menendez added that he is “not surprised” by Russia’s opposition to the UN tribunal.

“The world largely has come to the conclusion that, in fact, the Russians provided the rebels in Ukraine with the missile system that brought that plane down,” he stated.

Russia, however, immediately supported an independent investigation and contributed satellite imagery and other data to support the investigation into the crash.

A Dutch Safety Board preliminary report concluded that the aircraft fell apart in midair after being hit by numerous high-energy objects. The Dutch Safety Board’s final report is expected in October 2015.

Moscow currently supports the ongoing international investigations into the cause of the MH17 crash, and recently called for increased UN involvement in the investigation.
